As of September 25th 2025, Florida’s open carry laws have undergone a significant change, with the 1st District Court of Appeal invalidating the state’s previous open carry ban, allowing individuals to carry firearms openly in public spaces, subject to specific restrictions.
However, this does not override private property rights. Employers and private business owners can still prohibit firearms on their premises, and violating such a prohibition can lead to serious legal consequences.

Penalty for Violating a Private Business’s No-Gun Policy:
If a person carries a firearm into a private business that has clearly posted a “no weapons” sign, they are violating the property owner’s rules. While the state law does not criminalize carrying a firearm onto private property without a sign, the individual may be committing the crime of armed trespass if they refuse to leave after being asked to do so. This offense is classified as a third-degree felony, punishable by up to five years in prison and a fine of up to $5,000.

Legal Basis for Business Restrictions:
Florida law allows private property owners to prohibit firearms on their premises. Employers are advised to provide clear notices, such as visible “no weapons” signs, to enforce these rules.

The presence of such a sign is crucial for establishing the legal basis for a trespass charge.
Distinction from State Law Violations:
It is important to note that simply carrying a firearm in a business that does not have a “no guns” sign is not a violation of Florida’s state open carry law, which has been invalidated.

The legal risk arises from trespassing on private property, not from the act of open carrying itself under state law.

In summary:  If you choose to exercise your 2nd amendment right and carry, concealed or open, in a business that has a no firearms allowed posted at the entrance, and you are asked to leave the premises, just LEAVE.  Otherwise you could be charged with armed trespass.
